DETAILED DESCRIPTION OF GOODS AND/ OR SERVICES

1652 OUTDOOR AND SURVIVAL is a business in the outdoor/survival/tactical industry that markets outdoor/survival and tactical gear.

 

DELIVERY POLICY

Subject to availability and receipt of payment, requests will be processed within
4-5 WORKING DAYS (ORDERS ARE NOT DISPATCHED ON WEEKENDS OR PUBLIC HOLIDAYS) and delivery confirmed by way of COURIER

 

HOW TO RETURN PRODUCTS: 

Returning of products will be at your own cost, please note it is your responsibility to carry the cost of the courier or post and must include insurance.

1. RETURN AND REFUNDS POLICY

1.1

The provision of goods and services by 1652 OUTDOOR AND SURVIVAL is subject to availability.  In cases of unavailability,

1652 OUTDOOR AND SURVIVAL will refund the client in full within 30 days

 

1.2

To be eligible for a return, your item must be UNUSED and in the same condition that you received it. It must also be in the original packaging.

 

1.3

The client will be responsible for the return courier fee.                                  

If we determine that the item has a factory fault, we'll refund the shipping fee that the client had to pay. If we determine that there is no factory fault on the item, but rather damage caused through the courier process or by the client.

 

1.4

Subsequent to delivery and acceptance of the Product(s) ordered by you, you may return the Product(s) within 10 (TEN) days of date of delivery thereof.

 

1.5

In the event that Product(s) are returned, we will refund any monies paid by you in respect of the Product(s) returned, which refund is subject to a deduction of a reasonable charge by us not exceeding 15% of the value of the product purchased.

 

1.6

You will not be entitled to return a Product or Products

for reasons of public health or otherwise, a public regulation prohibits the return of the Product(s) once they have been delivered to you; or

 

1.7

you, or any other person, have partially or entirely disassembled or physically altered the Product(s), or permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, the Product(s) with other goods or property.

(no refund will be given on items which have been altered or damaged by clients).  Also mention guarantees, warranties, etc.

We warrant that:

 

2.1 THE PRODUCT(S)

2.1.1

the Product(s) ordered by you corresponds with the description provided on the Website or in store in writing or by a sales representative;

 

2.1.2

the Product(s) will be reasonably suitable for the purposes for which they are generally intended;

 

2.1.3

the Product(s) are of good quality, in good working order and free of any defects; unless states otherwise.

 

2.1.4

the Product(s) will be useable and durable for a reasonable period of time, having regard to the use to which they would normally be put and to all surrounding circumstances of their supply; and

 

2.1.5

the Product(s) comply with any applicable standards set under the Standards Act 29 of 1993, or any other public regulation.

 

2.2

The Product is intended to be used strictly in accordance with the manufacturer’s latest published instructions as set out on the Website or as on the Product itself. It is your responsibility to ensure that you use the Product strictly in accordance with those instructions and not for purposes for which the Product is not intended.

 

2.3

Should you, after delivery of the Product(s) discover that the Product(s) is faulty or defective, you agree that you will notify us with in the next 5 working days of delivery of such defect or fault on ;

2.4

Should you, at any time after delivery of the Product(s) discover or become aware of the fact that the Product(s) is faulty or defective, you agree that, until such time as the Product(s) is made available to us (or our agent) to collect and/or inspect and/or repair:

 

2.4.1

you will keep the Product(s) in the condition in which it was in when delivered to you;

 

2.4.2

you will not attempt to repair, modify, partially or entirely disassemble or physically alter the Product(s), or permanently install, affix, attach, join or add to, blend or combine with, or embed within, the Product(s) with other goods or property;

 

2.4.3

you will not make use of the product for any reason whatsoever;

 

2.4.4

you will not allow any other person to attempt to repair, modify, partially or entirely disassemble or physically alter the Product(s), or permanently install, affix, attach, join or add to, blend or combine with, or embed within, the Product(s) with other goods or property; and

 

2.4.5

you will keep the Product(s) safe and out of reach of children and/or other persons.

 

2.4.6

In the event that the product is faulty or defective and you wish to make use of the remedy or remedies available to you in the circumstances, we will require that you provide us with information pertaining to the defect or fault in reasonable detail, together with the delivery reference number and any other information which we may reasonably require.

 

2.5

Should it be brought to your attention within 3 (THREE) months of date of delivery of the Product(s) to you, that the Product(s) fail to comply with the warranties as set out in 2.1.1 to 2.1.5 above, you are, subject to 2.6 below, entitled to elect that:

 

2.5.1

the Product(s) be replaced; or

 

2.5.2

the Product(s) be repaired; or

 

2.5.3

we refund you upon return of the Product(s).

 

2.6

In the event that the Product(s) fail to comply with the warranties as set out in 2.1.1 to 2.1.5, you will not be entitled to make an election as set out in 2.5 , if such failure is due to the fact that the Product(s) have, since delivery to you:

 

2.6.1

been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or

 

2.6.2

been involved in any accident or damage caused by an incorrect attempt at modification or repair; or

 

2.6.3

been dealt with or used contrary to our or the manufacturer’s instructions for the Product; or

 

2.6.4

deteriorated through normal wear and tear.

Products are to be returned in their original box / casing with the original till slip / receipt / proof of purchase, failing which a reasonable handling fee will be charged.

 

3. CANCELLATION OF YOUR ORDER

3.1

If your motivation for cancellation is based upon fact that the order was made in error or that you have had a change of heart, we will refund you the total of the order, less 10% fees to cover any cost incurred to process and refund this transaction. If the order has already been dispatched, you will be refunded in full, less a maximum fee of 20%.

 

CUSTOMER PRIVACY POLICY

1652 OUTDOOR AND SURVIVAL shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, MasterCard, or by bank transfer into the 1652 OUTDOOR AND SURVIVAL bank account, the details of which will be provided on request.

 

CREDIT CARD ACQUIRING AND SECURTY

Credit card transactions will be acquired for 1652 OUTDOOR AND SURVIVAL via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa.  PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.  Users may go to www.paygate.co.za to view their security certificate and security policy. 

 

CUSTOMER DETAILS SEPARATE FROM CARD DETAILS

Customer details will be stored by 1652 OUTDOOR AND SURVIVAL separately from card details which are entered by the client on PayGate’s secure site.  For more detail on PayGate refer to www.paygate.co.za

 

MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa.  Transaction Currency is South African Rand (ZAR).

 

RESPONSIBILITY

1652 OUTDOOR AND SURVIVAL takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

 

COUNTRY OF DOMICILE

This website is governed by the laws of South Africa and 1652 OUTDOOR AND SURVIVAL chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

 

VARIATION

1652 OUTDOOR AND SURVIVAL may, in its sole discretion, change this agreement or any part thereof at any time without notice.
